5. PHOTOGRAPHY, AUDIO, AND VIDEO RECORDING

By attending the Event, you acknowledge and agree that ABI has the right to photograph, videotape, or digitally record you and your participation. These materials may be used for advertising, marketing, fundraising, promotional, training, and internal purposes, and may appear in public media including the internet, social media, and print publications of ABI or its partners. Materials may be substantially edited, altered, or modified. To the fullest extent permitted by law, you waive any rights or interests you may have in such materials.

If you do not wish to be photographed or recorded, you must notify a member of the ABI event staff upon arrival so that reasonable efforts can be made to accommodate your preference. Note that incidental capture in group settings may not be avoidable.

6. SESSION RECORDING AND INTELLECTUAL PROPERTY

ABI may record conference sessions for archival, educational, or promotional purposes. Speaker presentations and materials remain the intellectual property of their respective authors unless otherwise agreed in writing.

Attendees may not record, livestream, or broadcast any session or event content — audio or video — without prior written authorization from ABI and the relevant speaker(s). This includes the use of AI note-taking or recording applications (e.g., Otter.ai, Fireflies, etc.) in live sessions unless explicitly permitted by the session organizer.

Attendees are permitted to photograph presentation slides for personal reference only, unless a speaker explicitly requests otherwise.

7. LEAD RETRIEVAL AND EXHIBITOR CONTACT SHARING

The Whova app includes a networking feature that allows other registered attendees to view your profile information (such as name, title, and organization) if you have not opted out within the app settings. You may control your visibility preferences directly in the Whova app at any time.

If you choose to allow an exhibitor, sponsor, or industry partner to scan your badge or otherwise receive your contact information during the Event, you are opting in to receive communications from that entity. You will be subject to their privacy policy and must opt out with them directly. ABI is not responsible for communications received from third parties following such opt-in.

8. INFORMATION COLLECTION AND PRIVACY

ABI collects, manages, and may share your information in accordance with its Privacy Policy https://biochar.org/privacy-policy /and all applicable data privacy laws and regulations, including but not limited to applicable U.S. federal and state laws. By registering, you consent to the collection and use of your information as described therein.

Registration data (including name, organization, and email) may be shared with event partners, sponsors, and co-hosts (including the U.S. Biochar Coalition) for legitimate event administration and networking purposes. You may opt out of non-essential communications at any time.

9. VIEWS AND REPRESENTATIONS

The views expressed by any attendee, speaker, exhibitor, or sponsor are not necessarily those of ABI or its co-host organizations. You are solely responsible for the accuracy, legality, and content of any presentations, marketing materials, advertising, or web content you provide in connection with the Event.

ABI does not endorse, validate, or verify the accuracy, completeness, or legitimacy of any claims, representations, statements, products, services, or materials presented or promoted by speakers, exhibitors, or sponsors in connection with the 2026 North American Biochar Conference. The views, opinions, and content expressed by speakers, exhibitors, and sponsors are solely their own and do not reflect the positions or opinions of ABI or its affiliated organizations.

ABI assumes no responsibility or liability for any loss, damage, or harm arising from reliance on information provided by speakers, exhibitors, or sponsors. Attendees are encouraged to conduct their own independent research and due diligence.

10. SECURITY, SAFETY, AND ASSUMPTION OF RISK

By participating in the Event, you acknowledge and voluntarily assume all personal responsibility and risks associated with attendance, including risks arising from the venue, transportation, social events, and interactions with other attendees. You release ABI and its officers, directors, employees, volunteers, and agents from liability for any injuries, accidents, or losses arising from your attendance, and agree to indemnify and hold harmless ABI against any claims, damages, or expenses (including legal fees) arising from your actions or breach of these Terms.

Personal Property:  ABI is not responsible for lost, stolen, or damaged personal property during the Event.

You must comply with all applicable laws, venue rules, and safety guidelines at all times. ABI reserves the right to remove any person from the Event who poses a safety risk or violates these Terms.

11. HEALTH AND COMMUNICABLE DISEASE POLICY

ABI is committed to the health and safety of all attendees. By registering, you agree to:

  • Not attend if you are experiencing symptoms of a communicable illness (fever, respiratory symptoms, etc.) in the days immediately preceding or during the Event.
  • Comply with any health protocols required by the venue, local authorities, or ABI at the time of the Event, which may include but are not limited to masking or social distancing requirements.

ABI reserves the right to implement or modify health protocols at any time in response to public health guidance. Updated policies will be communicated via official channels. ABI shall not be liable for illness contracted in connection with the Event.

12. FORCE MAJEURE AND EVENT CHANGES

The Event schedule and content are subject to change. In the event of unforeseen circumstances or force majeure events — including but not limited to natural disasters, severe weather, pandemics, acts of terrorism, civil unrest, labor disputes, venue unavailability, or other circumstances beyond ABI’s reasonable control — the Event may be rescheduled, postponed, modified, or canceled.

ABI will communicate any material changes through official channels (website and registered email addresses). ABI cannot be held liable for losses or expenses incurred by attendees due to such events, including travel and accommodation costs. We strongly recommend purchasing appropriate travel insurance.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, ABI and its affiliated organizations, officers, directors, employees, volunteers, sponsors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of business, arising from or in connection with your registration for or participation in the Event, whether based on contract, tort, or any other legal theory, even if advised of the possibility of such damages.

ABI’s total liability to any individual attendee for any claim arising from the Event shall not exceed the amount paid by that attendee for their registration.

14. ACCESSIBILITY AND SPECIAL ACCOMMODATION REQUESTS

ABI is committed to making the Event accessible and welcoming to all participants. If you require special accommodations, please notify ABI at conference@biochar.org as early as possible and no later than two weeks before the Event. ABI will make reasonable efforts to accommodate your request, subject to venue constraints and advance notice.

15. CODE OF CONDUCT

ABI is committed to fostering a safe, inclusive, and harassment-free environment for all participants regardless of background, identity, or experience level. The following behaviors are required of all attendees, speakers, exhibitors, and sponsors:

  • Treat all participants with respect and professionalism.
  • Refrain from any form of discrimination, harassment, intimidation, or unlawful activity.
  • Avoid discriminatory, sexual, or otherwise offensive language, imagery, or behavior in any setting — in-person or online, including presentations, workshops, social events, personal interactions, and conference-related digital communications.
  • Do not share Event session content, recordings, or registration credentials without prior written authorization from ABI.
  • Comply with all venue rules and the instructions of ABI staff.
  • Alcohol and Substance Use:  Attendees are expected to consume alcohol responsibly and comply with all applicable laws and venue policies regarding alcohol consumption.  The use, possession, distribution, or sale of illegal drugs or controlled substances is strictly prohibited at the Event.

Violations of the Code of Conduct may result in immediate removal from the Event without refund and, if necessary, referral to venue security or law enforcement. ABI staff will determine appropriate sanctions at their sole discretion.

16. REPORTING VIOLATIONS

If you observe or experience a violation of these Terms or the Code of Conduct, please report it to a member of the ABI conference management team in person or by emailing conference@biochar.org. ABI will investigate all reports and take appropriate action. Reports may be made anonymously. Retaliation against anyone who makes a good-faith report is strictly prohibited.
